The Subcommittee considered the amendments to the laws on humanization of the prison system

February 24, 2016 on the basis of the subcommittee on activities of the State Penitentiary Service of Ukraine of the Verkhovna Rada Committee on Legislative Support of Law Enforcement, which is headed by MP Yuriy Miroshnichenko, held the sixth working meeting on the theme: "Legislative support of human rights in the penitentiary system of Ukraine".

The main focus of this working meeting was paid to the development of amendments for the second reading of the following bills: "On amendments to the Criminal Procedure Code of Ukraine concerning improvement of the use of the prisoners` incentives and penalties" (№ 2251а from 03.07.2015), "On amendments to the Criminal Procedure Code of Ukraine (concerning the humanization procedure and conditions of penal)" (№ 2252а from 03.07.2015), "On amendments to the Criminal Code of Ukraine for humanization of criminal liability for women" (№ 2254а from 03.07.2015), "On amendments to some laws of Ukraine concerning improvement of access to justice for persons held in detention facilities and prisons" (№ 2255а from 03.07.2015), "On amendments to the Criminal Procedure Code of Ukraine concerning improving guarantees of the rights of prisoners serving their sentence at the place of residence to the conviction or place of permanent residence of their relatives" (№ 2253а from 03.07.2015), "On amendments to the Law of Ukraine" on pre-trial detention" on the implementation of certain standards of the Council of Europe" (№ 2291а from 04.07.2015), "On Amendments to the Criminal Executive Code of Ukraine (regarding the improvement of conditions of detention of prisoners)" (№ 2685 from 21.04.2015).

The working meeting was attended by representatives of the Verkhovna Rada of Ukraine, of the General Prosecutor Office of Ukraine, the Institute of Criminal Executive Service of Ukraine, the Commissioner of the Verkhovna Rada of Ukraine on Human Rights, the Council of Europe office in Ukraine, the High Specialized Court for Civil and criminal cases, Ukrainian and international public organizations, Trade Union of the State penitentiary service of Ukraine, scientists with experience in the field of protection of human rights and freedoms.

Discussion of amendments to the bills was very productive.

Upon review and discussion of the seven above-mentioned draft laws, Subcommittee Chairman proposed a solution, which was supported by the participants of the working meeting, the following procedure:  after the discussion of amendments to bills on the Subcommittee on their harmonization according to the wishes of the represented institutions, the initiators of the draft laws will work directly with the experts of the Committee on Legislative Support of Law Enforcement; the final version of the table with the amendments will be sent to all participants of the working meeting and represented institutions to review their positions and opinions on this subject. After that it will be adopted negotiation of amendments to the draft laws for the second reading to be considered at the Committee.

In early March, is planned to hold the next working meeting on the basis of the subcommittee.

In addition, at the meeting was discussed the issue of introducing the institution of the penitentiary judge and the preparation of the draft law "On prevention and compensation measures in relation to torture, inhuman or degrading treatment or punishment in respect of convicts and persons taken into custody and administration of institute penal judges", initiated by an expert on the penitentiary reform of the Advisory mission of the European Union Vadim chovgan.

Chairman of the Subcommittee noted that the bill is a reformist and therefore requires serious consideration.

It was decided by the participants of the meeting to send letters with the text of the bill to provide expert evaluation in the relevant courts and Council of Judges of Ukraine.

Reconsideration of the bill will take place at the meeting, which is scheduled in March 2016.

The head of the secretariat of the Committee on Legislative Support of Law Enforcement Bogdan Drapyaty also informed the participants of the working meeting that in April-May 2016 a round table planned by the Committee on the topic: "The organization of the activities of the State Penitentiary Service and the condition of detention of persons in institutions of the Penitentiary Service".

Concluding the meeting, Yuri Miroshnichenko, thanked all those present for their active participation and noted with pleasure that these workshops is a good example of effective cooperation between the Ukrainian parliament, the executive and the judiciary, the international community and civil society.
